COLUMBIA, Mo. (AP) — Attorneys for a Missouri man scheduled to be put to death in November have filed motions seeking to halt his execution because he has a brain tumor.

Ernest L. Johnson’s attorneys argue he is mentally disabled and drugs used for lethal injections would cause pain and suffering because of his benign brain tumor.

The Columbia Daily Tribune reports Johnson’s attorneys filed a complaint on Thursday and a request for a temporary restraining order on Friday in federal court.

Johnson was convicted in 1995 of beating three employees of a Casey’s General Store in Columbia to death with a hammer and screwdriver after a robbery.
