Kirkwood City Council advancing ban on texting while driving

It may be legal under Missouri state law for drivers over 21 to text while driving, but it could soon be costly for those caught doing it in Kirkwood.

The Kirkwood City Council on Thursday night advanced a bill that would go beyond state law, and ban texting for all drivers. Florissant, Manchester and St. John have already enacted such bans.

But some legal experts say the city ordinances are unenforceable because of a clause in the state law that says it “preempts the field of regulating” the use of handheld cell phones in motor vehicles.

The proposed Kirkwood ordinance may get around that by charging violators with a city public safety violation which wouldn’t be reported to the state.

A final vote on the proposed Kirkwood ordinance is set for July 3rd.

It’s been illegal since January 1 for anyone to use any handheld electronic device while driving in the state of Illinois.
