"Gravity" holds top spot at the box office

NEW YORK (AP) — Topping the box office for the third straight week, the space adventure "Gravity" continues to be the box-office juggernaut of the fall.

The film, starring Sandra Bullock, earned $31 million over the weekend, according to studio estimates Sunday. The Warner Bros. film has now made more than $170 million in three weeks.

Tom Hanks' Somali pirate docudrama "Captain Phillips" also held in second place at the box office, taking in $17.3 million in its second week.

"Gravity" and "Captain Phillips," both likely Oscar contenders headlined by veteran stars, were able to best the horror film remake "Carrie" in its debut weekend. The Sony film opened with $17 million.

The WikiLeaks drama "The Fifth Estate" opened poorly, taking in a paltry $1.7 million. Sylvester Stallone's "Escape Plan" debuted with $9.8 million.

Man fires gun at police, shot and killed by officers

A would-be robber is dead after starting a shoot out with police in North County.

Around 9:30 AM, Sunday, a woman called police after a man tried to force his way into her home. The victim knew the suspect and directed police to his home. When police arrived at the house in the 10000 block on Winkler, the man started shooting at officers. The Florissant police officers returned fire and killed the suspect.

No officers were injured. The suspect's identity has not been released.

Bakery tax dispute heads to Missouri high court

JEFFERSON CITY, Mo. (AP) — The Missouri Supreme Court this week is considering taxes for baking doughnuts and cookies.

Ameren Missouri sought a tax refund on behalf of Schnuck Markets Inc. for energy used by the grocery store's bakeries. The company points to a tax exemption for energy used in manufacturing, processing, compounding, mining or producing, and a Department of Revenue regulation with examples of what is considered "processing" that deals with bakeries.

However, the state is not buying what they're cooking. The deputy solicitor says the tax exemption is aimed at producing products in industrial plants and facilities.

The Missouri Supreme Court ruled in a March 2012 decision a convenience store could not claim a tax exemption for energy used to prepare food. The court concluded food preparation for retail consumption is not "processing."
