The judge in the Colorado theater shooting trial is considering a defense request to dismiss a juror whose brother-in-law was shot in an armed robbery Wednesday in Denver.
The woman told Judge Carlos A. Samour Jr. about the shooting before testimony began Thursday. She said her brother-in-law is expected to recover and the incident won’t impact her service on the jury.
Lawyers for James Holmes later asked for the woman to be dismissed because they say other jurors have seen her crying.
In further questioning, the juror said three other jurors were with her when her husband called and said her brother-in-law was in a “major accident.” She said that’s all she told them.
Earlier this week, three jurors were dismissed amid concerns they were exposed to news reports about the case, leaving a total of 21 jurors and alternates.

James Holmes’ former girlfriend has finished testifying after being cross-examined by the defense with questions that seemed aimed at humanizing the Colorado theater gunman.
Gargi Datta (gar-ghee DAH-tah) says Holmes wanted to settle down and talked about buying a house in the Denver area, but she says she wasn’t ready for that.
Defense attorney Tamara Brady pointed out Holmes baked Datta chicken for dinner on Valentine’s Day 2012. Brady added Holmes showed no interest in guns when one of their friends went to a store to buy one.
Holmes has pleaded not guilty by reason of insanity in the July 2012 shooting at a suburban Denver movie theater. The attack left 12 people dead and 70 injured.

Colorado theater gunman James Holmes’ ex-girlfriend says the two broke up in February 2012 but continued to hang out as “friends with benefits.”
Gargi Datta (gar-ghee DAH-tah) says she confronted Holmes after he told someone who hit on her that she was his girlfriend. She says she reminded Holmes they weren’t a couple, but she doesn’t remember how he reacted.
Datta says they stopped hanging out in April 2012 – three months before the attack – because Holmes wanted to be more than friends, and she didn’t.
She says she never noticed him acting suicidal or manic, two symptoms he would later tell a state-appointed psychiatrist he was experiencing at the time.
Datta says she saw Holmes deliver a class presentation in May 2012. She says he was “extremely awkward” and had trouble connecting with the audience.
When a prosecutor asked if Holmes was acting crazy or babbling, Datta said no.

Colorado theater gunman James Holmes’ ex-girlfriend asked him to see a therapist months before the 2012 shooting, after he mentioned thoughts of killing people. But she says his thoughts “seemed very philosophical” and not like a concrete threat.
Gargi Datta (gar-ghee DAH-tah) testified Thursday about online chats she had with Holmes in the months they dated. Both were graduate students at the University of Colorado-Denver.
The two occasionally discussed problems at school and the difficulty of getting a good job without a doctoral degree.
Datta testified that in early 2012, she and another student asked Holmes to see a therapist, and Holmes said he already was.
